Terms of Use

Gift Genie, LLC · Last updated: May 26, 2026. These Terms of Use govern your access to and use of the Gift Genie iOS app.

These Terms of Use (the "Terms") form a binding agreement between you and Gift Genie, LLC ("Gift Genie," "we," "us," or "our") and govern your access to and use of the Gift Genie iOS application (the "App"). Gift Genie is a Delaware limited liability company. Apple In-App Purchase is used for digital subscriptions, AI credits, and premium features.

1. Acceptance of Terms

By creating an account or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.

2. Description of the App

Gift Genie helps you organize contacts, birthdays, holidays, and events, generate personalized gift ideas, save gift notes, and create digital cards with optional AI assisted suggestions and AI generated card covers. Some features are free; others require an active subscription, AI credits, or both.

3. Accounts and User Responsibility

• You must be at least 17 years old to use the App.
• You are responsible for the accuracy of the information you provide and for activity that occurs under your account.
• You are responsible for safeguarding your account credentials. Notify us immediately at giftgenie.owner@gmail.com if you suspect unauthorized access.
• Sign-in methods include email and password, Sign in with Apple, and Google Sign-In.

4. Subscriptions

• Gift Genie offers auto-renewable subscriptions, including Gift Genie Pro Monthly and Gift Genie Pro Yearly.
• Billing is handled exclusively through Apple In-App Purchase and charged to your Apple ID at confirmation of purchase.
• Subscriptions automatically renew at the same price and duration unless canceled at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period.
• Prices, currency, and subscription duration are displayed in the App on the paywall before you complete the purchase, in accordance with App Store rules.
• You can manage or cancel a subscription at any time in Settings → Apple ID → Subscriptions on your device. Canceling stops future renewals; Pro features remain active until the end of the current paid period.

5. AI Credits

• The App offers consumable AI credit packs that are purchased through Apple In-App Purchase.
• AI credits are used to access premium AI features such as Gift Concierge, AI card cover generation, AI cover refinement, and similar AI assisted features.
• AI credits have no cash value, are not transferable, are not redeemable for money or other property, and may not be combined across accounts.
• Credits may expire if a Pro subscription that granted them is canceled, as disclosed on the paywall at the time of purchase. Purchased top-up credits do not expire while your account is active, unless required by law.

6. Restore Purchases

If you have purchased a Pro subscription or AI credits and they are not showing on a device, you can restore them inside the App by opening Profile → Manage Plan → Restore Purchases (or from any paywall screen). Restoring requires signing in with the same Apple ID that made the original purchase.

7. Refunds and Cancellations

All purchases are handled by Apple. Refund eligibility and processing are governed by Apple's App Store policies. To request a refund, visit reportaproblem.apple.com or contact Apple Support. To cancel a subscription before the next renewal, open Settings → Apple ID → Subscriptions on your device. Deleting your Gift Genie account inside the App does not cancel an active App Store subscription.

8. AI Generated Content

Gift suggestions, card messages, AI generated card covers, and similar outputs are produced by third party AI models based on the information you provide. AI outputs are assistive and may be inaccurate, incomplete, biased, or out of date. You should review AI outputs before relying on them, sending them to anyone, or making a purchase based on them. Gift Genie does not guarantee the accuracy, availability, suitability, or pricing of any gift suggestion or AI generated output.

9. User Content

You are responsible for the content you enter, upload, save, or generate in the App, including contact information, gift notes, card messages, photos, and prompts you submit to AI features. You represent that you have the right to provide the content you input and that it does not infringe the rights of any other person. Content you create remains yours; you grant Gift Genie a limited, worldwide, royalty free license to store, process, and display that content solely to operate the App for you and to provide the features you request.

10. Acceptable Use

You agree not to use the App to:

• Violate any law or regulation.
• Harass, threaten, defame, or harm another person.
• Infringe the intellectual property, privacy, or publicity rights of others.
• Upload, submit, or generate content that is illegal, obscene, sexually explicit involving minors, or otherwise prohibited by Apple's App Store guidelines.
• Submit false, misleading, or deceptive information.
• Transmit malware, viruses, or harmful code.
• Reverse engineer, scrape, or interfere with the App or its underlying services.
• Attempt to gain unauthorized access to any account, system, or data.

We may suspend or terminate accounts that violate these rules.

11. Affiliate and Retailer Links

Gift Genie, LLC participates in the Amazon Services LLC Associates Program and may participate in other affiliate or retailer programs. Some product links in the App will open in your browser and direct you to a third party retailer such as Amazon, Walmart, or a gift card provider. We may earn a commission on qualifying purchases at no additional cost to you. We do not control retailer pricing, availability, shipping, returns, customer service, or any other aspect of the retailer's site. Purchases from third party retailers are governed by the retailer's own terms and privacy policy and are separate from Apple In-App Purchase.

12. Privacy

Our handling of your information is described in our Privacy Policy, which is incorporated into these Terms by reference.

13. Intellectual Property

The App, its branding, designs, source code, AI prompts, layouts, and original content are owned by Gift Genie, LLC and protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no other rights or licenses are granted to you. You may not copy, modify, distribute, sell, lease, or create derivative works of the App or any of its content without our written permission.

14. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error free, or free of harmful components. AI generated outputs and product information sourced from third parties may be inaccurate or out of date. You use the App at your own risk.

15. Limitation of Liability

To the maximum extent permitted by law, Gift Genie, LLC and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, or goodwill, arising out of or in connection with the App, even if advised of the possibility of such damages. Our total cumulative liability arising out of or related to these Terms or the App will not exceed the greater of (a) the amount you paid to Gift Genie in the twelve months immediately preceding the event giving rise to the claim, or (b) twenty United States dollars (USD 20).

16. Indemnification

You agree to indemnify and hold harmless Gift Genie, LLC and its officers, members, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your use of the App, your content, or your violation of these Terms or applicable law.

17. Termination

You may stop using the App at any time and may delete your account inside the App at Profile → Security & Account → Delete Account. We may suspend or terminate your access to the App at any time for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive, including Sections 9, 12, 13, 14, 15, 16, 18, and 19.

18. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Subject to applicable consumer protection laws in your jurisdiction, you and Gift Genie agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising out of or relating to these Terms or the App.

19. Changes to These Terms

We may update these Terms from time to time. If we make material changes we will notify you through the App or by email. Your continued use of the App after the effective date of an update constitutes your acceptance of the revised Terms.

20. Apple Specific Terms

• These Terms are between you and Gift Genie, LLC, not Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, who will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation for the App.
• Apple is not responsible for addressing any claims relating to the App, including product liability claims, regulatory claims, or claims that the App fails to conform to legal requirements.
• Apple and its subsidiaries are third party beneficiaries of these Terms and may enforce them against you.
